Terms of Service

1. Who We Are

ZestyText is an opt-in SMS broadcast service operated by Alpha Leonis Production Studio LLC ("Company," "we," "us," or "ZestyText"). ZestyText is the registered SMS sender for all messages broadcast through the platform.

2. How ZestyText Works

ZestyText is a platform where:

• Customers ("you") create events and pay for one or more text broadcasts
• Customers receive a unique sign-up link and QR code to share with the people they want to reach
• Recipients ("subscribers") sign up directly through ZestyText, providing their consent to receive text messages from ZestyText about that specific event
• ZestyText sends the broadcasts on the customer's behalf, identifying ZestyText as the sender and the customer's event as the topic
• ZestyText handles all opt-out requests, message moderation, and compliance recordkeeping

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use ZestyText. By using the platform, you represent that all information you provide is accurate, current, and complete.

4. Your Obligations

By creating an event and sending messages through ZestyText, you agree:

• Not to share your sign-up link or QR code in a misleading, deceptive, or coercive manner
• Not to use ZestyText to send threatening, harassing, sexual, hateful, or otherwise abusive content (see our Acceptable Use Policy)
• Not to use ZestyText to send marketing or solicitation that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA guidelines, or any federal, state, or local law
• Not to impersonate any person or entity in your event name or message content
• Not to send messages that include sexually explicit content, hate speech, illegal substances, weapons, gambling solicitation, payday loan offers, or other prohibited categories under carrier rules
• To accept that ZestyText may refuse to send any message that violates these terms or our Acceptable Use Policy
• To accept that all sales are final once a message has been queued for sending

5. ZestyText's Role and Responsibilities

ZestyText takes responsibility for:

• Operating the opt-in mechanism on behalf of customers
• Maintaining records of every subscriber's consent (timestamp, IP address, consent text shown, and method used)
• Identifying ZestyText as the sender on every outgoing message
• Processing STOP keywords and other reasonable opt-out requests promptly
• Screening every outgoing message through automated content moderation before it is sent
• Honoring carrier and FCC requirements applicable to opt-in SMS broadcast services

6. Content Moderation

Every message you submit is reviewed by an automated content moderation system before payment is taken. If your message is flagged as inappropriate, threatening, harassing, sexual, hateful, deceptive, fraudulent, or otherwise in violation of our Acceptable Use Policy, the message will be blocked and you will not be charged. You may edit and resubmit. Repeated violations may result in account suspension.

7. Pricing and Payment

All plans are one-time payments. There is no subscription. The cost depends on the plan you select. Payment is processed through Stripe. ZestyText does not store your payment card information.

Each broadcast is a separate purchase. You may send as many reminders as you wish, each at the price of the plan you select for that send.

8. Refunds

See our Refund Policy. Generally, all sales are final once a message has been sent. Messages blocked by moderation before payment do not result in any charge. Stripe-processed refunds may be issued at our discretion in cases of platform error.

9. Account Suspension and Termination

We may suspend or terminate your access — or suspend any specific event — at any time, with or without notice, for violations of these Terms or the Acceptable Use Policy, or in response to legal demands, abuse reports, or carrier requirements. Refunds are not generally provided for suspensions due to violations.

10. Subscriber Data

Subscriber phone numbers and consent records are held by ZestyText. You can view your event's subscriber list in your dashboard. You may not export, sell, share, or use this data outside of ZestyText. Subscribers are users of ZestyText, not your customers.

11. Disclaimers

ZestyText is provided "as is." We do not guarantee 100% message delivery. Carriers may filter, delay, or reject messages for reasons outside our control. We do not guarantee uninterrupted service.

12. Limitation of Liability

To the maximum extent permitted by law, ZestyText (and Alpha Leonis Production Studio LLC) is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform. Our maximum aggregate liability for any claim is limited to the total amount you have paid to ZestyText in the prior 12 months.

13. Indemnification

You agree to indemnify and hold ZestyText harmless from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the platform.

14. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of ZestyText after changes constitutes acceptance of the updated Terms. Material changes will be reflected in the "Last updated" date above.
